NRI TDS on a property sale, and how much you can keep

If you live abroad and sell property in India, the buyer must deduct tax from the price before paying you. See how much, and how much a lower deduction certificate would leave in your hands at closing.

How the numbers work

On the price, not the gainWhen an NRI sells, the buyer must deduct tax on the whole sale price, not just your profit. On a long-term sale above ₹1 crore that is 14.95%.
A certificate cuts it

Apply to the tax department for a lower deduction certificate before the agreement. The buyer then deducts only on your actual gain, and the rest reaches you at closing.

No TAN for most buyers

From 1 October 2026 a resident individual or HUF buyer deducts and pays this using their PAN. Companies, firms and NRI buyers still need a TAN.

The default TDS rates for an NRI seller

Sale price Long-term (over 24 months)
Up to ₹50 lakh 13.00%
₹50 lakh – ₹1 crore 14.30%
Above ₹1 crore 14.95%
Short-term (24 months or less) about 31%–43%

These are 12.5% (or 30% for short-term), plus surcharge and 4% cess. The buyer deducts them from the price and deposits them; you claim the excess back in your return.

Getting the money out

Sale proceeds go into your NRO account. You can send up to USD 1 million a financial year abroad from it, with your CA’s certificate and the bank’s remittance forms (Forms 145 and 146, earlier 15CA and 15CB). Read our full guide to selling property in Delhi as an NRI.

Questions people ask

How much TDS is deducted when an NRI sells property in India?
On a long-term sale (held more than 24 months), 12.5% plus surcharge and 4% cess on the whole sale price: 13% up to ₹50 lakh, 14.30% between ₹50 lakh and ₹1 crore, and 14.95% above ₹1 crore. On a short-term sale the base rate is 30%, so the deduction is roughly 31% to 43% depending on the price.
Why is TDS on the full sale price and not on the profit?
Because the buyer does not know your cost. The law makes the buyer deduct on the whole amount unless you give them a lower deduction certificate from the tax department, which sets the rate on your actual gain.
How do I get a lower deduction certificate as an NRI?
Apply online on the TRACES portal using Form 128 (earlier Form 13) before signing the agreement to sell, with your purchase deed, sale agreement draft, cost and improvement details and your PAN. The assessing officer works out your likely tax and issues a certificate for that amount. It usually takes a few weeks.
Does the buyer need a TAN to buy property from an NRI?
From 1 October 2026 a resident individual or HUF buyer does not; they pay the deducted tax using their PAN. A company, firm, LLP or non-resident buyer still needs a TAN.
How long does the TDS refund take if I do not get a certificate?
You claim it in your income-tax return for the year of sale, so the money typically comes back a year or more after the sale, once the return is processed.
